The Cross-Examination

Every other file in this case is a statement given somewhere quiet — a locker, a dossier, a letter from the cell. This is the one place they all stood in the same room at the same time and answered for it under oath. The morning the Swamp Superior Court cross-examined the defense.

The prosecution called it an open-and-shut forgery. Then it put four sworn frogs on the stand and asked them to hold their stories under pressure. They held. What follows is the transcript, verbatim, objections and all — the moment the testimony you have been reading in pieces actually plays out.

  1. THE COURT — CALL TO ORDER

    This court is in session. We are here on seventeen counts of check forgery. The record will note the defendant offered his tongue for casting before anyone asked him to. The record will also note that guilty frogs, in my experience, do not do that. Prosecution, call your first cross.

  2. THE PROSECUTIONfor the pond

    Detective, you caught this case. You built the file that put this frog in the dock. And now you sit for the defense. Isn't the truth simply that you grew fond of a likeable amphibian and lost your nerve?

    If I'd lost my nerve I'd have buried the second tongue-cast, not entered it as Exhibit A. I looked at the two prints under a lamp — the one PeePoo gave freely, and the one lifted off the checks. They're identical-twin close. But at the tip, the forgery curls. His lies dead flat. That curl is the whole case, and it points across the water, away from my defendant.

  4. OBJECTION — THE PROSECUTION

    Speculation. The witness invites this court to imagine a second frog he has never so much as interviewed.

  5. THE COURT — OVERRULED

    The curl is not speculation, counselor. It is a cast, sealed and lamped. The detective may finish.

    I asked the department for a warrant and a cast kit to cross the pond and settle it. They won't give me one. I'll let the court decide what that silence weighs. But the tongue on the checks isn't PeePoo's, and I've spent twenty years learning to tell.

  7. THE PROSECUTIONfor the pond

    A curl. The state's whole reasonable doubt is a curl. Analyst, you measured it. Could a curl at the tip not simply be the check paper warping the print?

    Paper warps at random. This curls the same way, at the same tip, on all seventeen checks. Warping doesn't repeat itself seventeen times to the fraction. A tongue that curls does. I measured every one and I'll stake my whole proboscis on the tip. That is not warp. That is a signature — just not my defendant's.

    Two tongue-casts, side by side under the court lamp. The flat and the curl. The gallery is asked not to lean in past the rail.

  10. COUNSELOR CROAKSWORTHfor the defense

    Your Honor, I have filed this same motion seventeen times — once for every check — and I will file it an eighteenth: the frog in this dock has the wrong tongue for the crime. My client cannot forge his own name flat and have it come out curled. The prosecution keeps arguing identity and hoping no one asks which twin.

    Then account for the tears, bailiff. The defendant wept in this very courtroom. Isn't that the oldest trick a guilty frog knows — a performance for the gallery?

    I stand three feet from him every session. I've watched a hundred frogs fake it in that chair. PeePoo can't fake anything — that's the whole problem with him. The tears were real because he doesn't have the machinery to make fake ones. If crying about being framed is a trick, it's the worst-planned trick I ever saw.

  13. OBJECTION — THE PROSECUTION

    The bailiff is not a witness to character. He is court staff.

  14. THE COURT

    He is the frog closest to the defendant in this room, counselor. If proximity to the accused disqualifies a witness, your whole case goes with him. Overruled. The defense may call its last.

    I hatched two boys from one ribbon of eggs. I have told them apart by the tongue since before either could hop. One lies flat when it lands. One always curled — reaching, since he was small, for a thing that wasn't his to take. You have the flat one in your dock. The curled one is across the water, and he knows exactly which of my sons is sitting where.

  16. THE COURT — RECESS

    The court will recess. Let the record show four witnesses, one exhibit, and not one flat tongue among the forgeries. The case remains open. It stays open, frankly, as long as the wrong twin sits in that chair.
